Welcome to VietEcho. These Terms of Use (“Terms”) govern your access to and use of VietEcho.com, including its English- and Vietnamese-language pages, articles, videos, newsletters, member features, artificial-intelligence-assisted tools, donation features, and related services (collectively, the “Site”).

The Site is operated by Echo Enterprise LLC, doing business as VietEcho (“VietEcho,” “we,” “us,” or “our”). Contact email: info@vietecho.com.

By accessing or using the Site, creating an account, subscribing to updates, or making a donation, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of legal majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

2. News, Editorial, and General-Information Content

VietEcho publishes news, culture, community, travel, fashion, health, wellness, video, opinion, and other informational content. Although we strive for accuracy and may update or correct published material, we do not guarantee that all content is complete, current, error-free, or suitable for every purpose.

Articles may include reporting, commentary, summaries, translations, interviews, guest contributions, sponsored material, or information obtained from third-party sources. Opinions expressed by authors, guests, interviewees, or users are their own and do not necessarily represent VietEcho’s views.

You are responsible for evaluating information before relying on it. When a matter is important, time-sensitive, or capable of causing harm, verify it with primary sources or an appropriately qualified professional.

3. No Medical, Legal, Financial, or Other Professional Advice

Health and wellness content on the Site is provided for general education and information only. It is not medical advice and is not a substitute for diagnosis, treatment, or individualized advice from a licensed healthcare professional. Do not delay or disregard professional medical care because of information found on the Site. For a medical emergency, call 911 or your local emergency number.

The Site also does not provide legal, financial, tax, investment, mental-health, or other professional advice unless expressly stated in a separate written agreement. Consult an appropriately licensed professional regarding your individual circumstances.

4. Accounts and Account Security

Certain features may require an account. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You must promptly notify us at info@vietEcho.com if you suspect unauthorized access or a security breach. You may not impersonate another person, create an account using false or misleading information, share credentials in a way that compromises security, or use another person’s account without permission.

We may reject, suspend, restrict, or terminate an account when reasonably necessary to enforce these Terms, protect users or the Site, comply with law, address security risks, or prevent abuse.

5. Email Updates and Communications

If you subscribe to VietEcho updates, you consent to receive the communications you requested. You may unsubscribe from promotional emails at any time through the unsubscribe link in the message or by contacting info@vietecho.com. We may still send non-promotional messages necessary to operate your account or respond to your requests.

Carrier, internet, or data charges may apply. Delivery is not guaranteed and may be affected by third-party service providers.

6. VietEcho AI Guide and Automated Features

The Site may provide an AI-assisted guide, search tool, translation, summary, recommendation, or other automated feature. These features may generate incomplete, inaccurate, outdated, or misleading results. They are provided to help users navigate and discover Site content and must not be relied upon for medical, legal, financial, safety-critical, or other high-stakes decisions.

Do not submit confidential, sensitive, privileged, or unnecessary personal information to an AI or search feature. VietEcho may modify, limit, suspend, or discontinue an automated feature at any time. Information about how data is handled is provided in our Privacy Policy.

7. User Submissions and Community Conduct

The Site may allow comments, profile information, messages, article submissions, photographs, videos, tips, feedback, or other material submitted by users (“User Content”). You retain ownership of your User Content.

By submitting User Content to a public or publication feature, you grant VietEcho a worldwide, nonexclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, edit for length, clarity, formatting, translation, accessibility, or legal compliance, publish, display, distribute, promote, and otherwise use that User Content in connection with operating and promoting VietEcho. This license continues for material already published or reasonably retained in backups, legal records, or archival copies, even if you later delete your account. Private communications are not licensed for public use merely because they are sent to us.

You represent that you own or have all rights needed to submit your User Content and that it does not violate another person’s rights or any law. You may not submit or use the Site to distribute content that:

is unlawful, fraudulent, threatening, harassing, hateful, defamatory, obscene, exploitative, or invasive of privacy;
infringes copyright, trademark, publicity, privacy, confidentiality, or other rights;
contains malware, malicious code, spam, unauthorized advertising, or deceptive links;
reveals another person’s sensitive personal information without authorization;
impersonates another person or misrepresents an affiliation; or
interferes with the Site, its security, or another user’s access.
We are not obligated to publish, monitor, or retain User Content. We may review, refuse, edit, remove, restrict, or preserve it when reasonably necessary to operate the Site, enforce these Terms, protect safety or rights, investigate suspected misconduct, or comply with law.

8. Intellectual Property

Except for User Content and identified third-party material, the Site and its content—including VietEcho’s name, logos, designs, text, graphics, photographs, video, audio, software, compilations, and arrangement—are owned by or licensed to VietEcho and are protected by intellectual-property laws.

VietEcho grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for lawful personal, noncommercial purposes. You may share links to public Site pages and make brief quotations when permitted by law and accompanied by appropriate attribution and a link to the source.

Without prior written permission, you may not reproduce, republish, sell, license, scrape, systematically download, create a competing database from, remove rights notices from, or commercially exploit Site content. You also may not use VietEcho content or User Content to train, fine-tune, develop, or evaluate an artificial-intelligence or machine-learning system except with VietEcho’s prior written permission or where applicable law clearly permits it.

9. Copyright Complaints

VietEcho respects intellectual-property rights. If you believe material on the Site infringes your copyright, send a notice to:

Your notice should identify the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement that the disputed use is not authorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature. We may forward the notice to the person who posted the material. Knowingly making a material misrepresentation in a copyright notice may result in liability.

10. Third-Party Content, Links, and Embedded Services

The Site may contain links to, quotations from, or embedded content and services operated by third parties, including video, social-media, payment, analytics, advertising, and content providers. VietEcho does not control and is not responsible for third-party availability, accuracy, security, privacy practices, content, products, or services. Your dealings with a third party are governed by that party’s terms and policies.

The presence of a link, embed, advertisement, or reference does not necessarily mean VietEcho endorses the third party or its views.

11. Advertising, Sponsorships, and Affiliate Links

VietEcho may display advertisements, sponsored content, paid placements, or affiliate links. When reasonably required, we will identify sponsored or commercial relationships. If you purchase through an affiliate link, VietEcho may receive compensation at no additional cost to you. Advertisers and sponsors are responsible for their claims, products, and services.

12. Donations

If the Site accepts donations, donations are voluntary and, except where required by law or expressly stated otherwise, nonrefundable. A donation is not a purchase of editorial coverage, influence, goods, or services. VietEcho retains editorial independence.

Do not assume that a donation is tax-deductible. It is tax-deductible only if VietEcho expressly states that the receiving organization is eligible to receive tax-deductible contributions and provides appropriate documentation. Payment processing may be performed by a third party under its own terms and privacy policy.

13. Prohibited Uses

You may not:

violate any applicable law or another person’s rights;
attempt to gain unauthorized access to the Site, accounts, systems, or data;
probe, scan, disrupt, overload, reverse engineer, or circumvent Site security or access controls;
introduce malware or use bots, scripts, scraping, or automated collection in a manner that burdens the Site, evades restrictions, or violates these Terms;
manipulate engagement, interfere with other users, or use the Site for spam, fraud, or deceptive conduct;
collect personal information about others without lawful authorization; or
use Site content, branding, or services to imply VietEcho sponsorship or endorsement without written permission.

14. Availability, Changes, and Corrections

We may correct, update, remove, archive, translate, or change content or Site features at any time. We do not guarantee uninterrupted or secure access, preservation of any content, or compatibility with every device or browser. The Site may be unavailable because of maintenance, technical failure, third-party services, emergencies, or circumstances outside our control.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VIETECHO DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND UNINTERRUPTED AVAILABILITY. VIETECHO DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT ANY RESULT OR INFORMATION WILL MEET YOUR NEEDS.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIETECHO AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, VOLUNTEERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF VIETECHO AND THE ABOVE PARTIES FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO VIETECHO FOR THE RELEVANT SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless VietEcho and its owners, directors, officers, employees, contributors, contractors, volunteers, licensors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs, including attorneys’ fees, arising from your User Content, your unlawful or unauthorized use of the Site, or your material violation of these Terms or another person’s rights.

18. Language

These Terms may be provided in English and Vietnamese for convenience and accessibility. The English version controls if the versions conflict or are interpreted differently. If VietEcho intends both versions to have equal legal effect, obtain legal review and replace the preceding sentence with an appropriate bilingual-control clause.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising from or relating to the Site or these Terms must be brought in the state or federal courts located in or serving Tarrant County, Texas, and you and VietEcho consent to their personal jurisdiction and venue. This section does not prevent either party from seeking relief in small-claims court when eligible or from seeking emergency injunctive relief in an appropriate court.

Mandatory consumer-protection rights that apply where you live are not waived by these Terms.

20. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the “Last updated” date. If changes are material, we may provide additional notice when reasonably required. Changes become effective when posted unless a later date is stated. Your continued use of the Site after the effective date of revised Terms constitutes acceptance of those Terms.

21. Termination

You may stop using the Site at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, Site operation, protection of users or third parties, or enforcement of these Terms. Provisions that by their nature should survive termination—including intellectual-property, disclaimers, limitations of liability, indemnification, language, governing-law, and miscellaneous provisions—will survive.

22. Miscellaneous

These Terms and the Privacy Policy constitute the entire agreement between you and VietEcho concerning the Site, except for any separate written agreement that expressly applies. If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. VietEcho’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent; VietEcho may assign them in connection with a reorganization, merger, sale, or transfer of the Site or its operations.
